CNN —Party City exited bankruptcy on Wednesday after a US judge signed off on the retailer’s reorganization plans. The plan cancels nearly $1 billion of Party City’s debt, and while some of Party City’s nearly 800 US stores will close due to the bankruptcy agreement, the majority will stay open, according to the company. In a statement, Party City said it had renegotiated many of its leases and exited “less productive locations.” That means many of Party City’s workers will stay employed. However, those who held Party City’s stock did not fare as well in the bankruptcy agreement. An August filing by Party City’s financial adviser, Moelis & Co., estimated that the retailer is currently worth between $450 million and $775 million.

The company has held confidential talks with debt holders about spinning off its Anagram unit, the report said, adding that talks are continuing and the situation may change. Party City did not immediately respond to Reuters request for a comment. In January, Party City filed for bankruptcy protection after it saw its fortunes taper following a slowdown in sales due to lockdowns and store closures.

Why it matters: The count of publicly listed companies traded on US exchanges has fallen substantially from its peak in 1996. It’s not that America has half as many companies as 30 years ago – it’s that companies are increasingly staying private, largely outside the scrutiny of the public eye. Corporate bankruptcies just hit their highest levels since 2010, according to new data. This year's bankruptcies include Party City, Serta Simmons, and the parent of Silicon Valley Bank. There were 54 corporate bankruptcies in the US in May, bringing this year's total to 286, according to new data from S&P Global Market Intelligence. That's the highest number of US corporate bankruptcies recorded for the first five months of the year since 2010, the data provider said. This year's bankruptcies include party goods retailer Party City and mattress seller Serta Simmons, both of which filed for restructuring protection in January.

Bed Bath & Beyond files for bankruptcy

In its bankruptcy filing, Bed Bath & Beyond said it had $5.2 billion in debt and assets of just $4.4 billion. Discount chains such as HomeGoods and TJ Maxx have also undercut Bed Bath & Beyond’s prices. Without the differentiators of the lowest prices or widest selection, Bed Bath & Beyond’s sales stagnated from 2012 to 2019. And Bed Bath & Beyond is the latest retail chain to file for bankruptcy this year.

Private equity-owned companies make up nearly three-quarters of Moody's list. In addition to higher interest payments, Moody's noted, many of the downgraded companies have fewer funding paths to staying afloat. Sixteen of the 30 companies that fell off Moody's at-risk list last quarter did so through defaults, not improved financial outlooks. As defaults rise, distressed debt exchanges will be the route of choice for many companies and their private equity owners, Moody's noted. Of the other companies that fell off Moody's list last quarter, seven opted instead to file for bankruptcy.
David's Bridal files for bankruptcy

But it hasn’t been enough for David’s Bridal, the largest bridal retailer in the United States. David’s Bridal has been hurt by a range of factors, including inflation and competition from online retailers and secondhand retailers. “An increasing number of brides are opting for less traditional wedding attire, including thrift wedding dresses,” David’s Bridal said in a bankruptcy filing. David’s Bridal has also been hurt by changes in how women shop for wedding dresses. But if David’s Bridal is not able to find a buyer, it could have to close all stores and liquidate.
The American consumer has bad news for the economy

That’s why Wall Street is already fretting over Friday’s retail sales report, which is expected to show that the mighty American consumer is pulling back. Economists forecast that retail sales fell 0.4% in March from the month before. But Goldman Sachs and Bank of America analysts say core sales — that’s without autos, gasoline, and building materials — slowed by about 1%. A taxing problem: Still, the health of the American consumer is still relatively strong, the BofA analysts said. A one-bedroom apartment had a median rent of $4,150, up 9.6% from last year, while a two-bedroom apartment had a median rent of $5,680, up 18.3% from a year ago.
CNBC's Jim Cramer said Thursday that he's still searching for the first sign of a recession, even though it's all anyone seems to be talking about. Meanwhile, timeshare company Marriott Vacations Worldwide has racked up 12% contract sales growth for the quarter and is predicting a "very solid" 2023, according to Cramer. Competing timeshare company Travel + Leisure has said it is not seeing a slowdown. In retail, aside from Party City, there aren't many bankruptcies and somehow "deeply troubled" Bed Bath & Beyond is still alive, Cramer noted. "We've had red-hot economies in the past with more retail closures than we're seeing right now," Cramer said.
Off-price chains are likely to get a boost in the months ahead as shoppers seek low prices. Ross Stores is planning to open 100 new locations this year, while T.J. New York CNN —Big retailers say consumer demand is starting to buckle from the strain of inflation and customers are making changes in how they shop. Target (TGT), Best Buy (BBY), Macy’s (M) and other chains say shoppers have pulled back on discretionary goods like clothing, electronics and home improvement. The slowdown could mean consumers will see more discounts on shelves as stores look for ways to entice shoppers and work down their inventory. “The consumer electronics industry continues to feel the effects of the broader macro environment and its impact on consumers,” Best Buy finance chief Matt Bilunas said. Best Buy predicts its comparable sales will decline 3% to 6% this year.
New York CNN —Forecasts from Walmart and Home Depot made for a grim day of trading on Tuesday. The mega retailers’ predictions of a weakening economy and a dip in consumer spending this year sent markets tumbling as Wall Street seemed to realize that the Federal Reserve’s campaign to quell inflation could yet lead to recession. What’s happening: We’ve written about the remarkable strength of the US consumer quite a bit here at Before the Bell. Consumer spending accounts for about 70% of America’s gross domestic product, the broadest measure of the US economy, so it’s nearly impossible for the economy to enter a recession as long as consumer spending is growing. American shoppers have almost single-handedly kept the US economy afloat by continuing to shell out cash for purchases despite stubbornly high inflation.
Walmart expects a slowdown this year

New York CNN —Walmart had a strong holiday shopping season, but the year ahead will be more challenging for America’s largest retailer. Walmart (WMT) forecast slower sales and profit growth, disappointing investors and sending its stock down during morning trading Tuesday. Government inflation data shows that grocery prices have increased 11.3% over the last year, and more shoppers are turning to discount chains like Walmart to save money. Sales were slower for traditional holiday products like toys, electronics and clothing, a sign that some consumers were cautious on discretionary spending. Holiday sales were sluggish for many retailers, and the industry is expected to have a weaker 2023.

Retailers Hope to Bargain for Lower Ocean-Freight Rates

Richard Galanti, chief financial officer of Costco Wholesale Corp. , said lower freight rates should lead to price cuts at the members-only retailer, which imports more than 200,000 containers a year from Asia. An International Monetary Fund study found that when ocean-freight rates double it causes inflation to rise by 0.7 percentage point. Jonathan Ostry, a Georgetown University professor and a co-author of the study, said cutting shipping rates in half should reduce inflation by the same amount. In the ocean-shipping spot market, where importers book containers without a contract, rates have dropped to $1,000 on some trans-Pacific routes. But they say lower ocean shipping expenses will help in steadying prices.
